Know all men by these presents that the
Texas & New Orleans Rail Road Company, herein acting in the
absence of its President, by its Vice President, I. S. Roberts as
Principal and Cornelius Ennis and Rot. Brewster as sarctier, are held
and firmly bound to Major T. S. Moris, Quarter Master of the
Confederate States Army, herein acting for and in behalf of the
Confederate States of America, and to his successors in office on the
full sum of Fifteen thousand (15,000) Dollars: which sum, well and
truly to be paid, we bind ourselves and each of us jointly and
severally, by these presents, our Heirs, Executors and Administrators. |
Given under our hands and seals, using
scrolls by way of seals. Done at Houston, Texas on this twenty-first
day of February 1862. |
The Condition of the foregoing obligation
is such that |
Whereas the Confederate States of America
have advanced to the said Rail Road Company the sum of Fifteen
thousand (15,000) Dollars to enable said Company to complete said Road
from the City of Houston to the Town of Orange, on the Sabine River,
in the State of Texas, and the said Company propose to reimburse said
Confederate States of America to the said amount of Fifteen thousand
(15,000) Dollars, in Transportation of Freight and Passengers over
said Road or any portion thereof, whenever called upon by said
Confederate States of America. Now should said Company complete said
Rail Road so as to run cars through from the City of Houston too the
Town of Orange in forty working days from the date hereof and
reimburse the said Confederate States of America as proposed, then the
Bond to be Null and Void, otherwise, to remain in force and effect. |

Personally appeared before me, the
undersigned, a Notary Public within and for the County and State
aforesaid Cornelius Ennis, and Robt Brewster of the County of Harris
and State of Texas both to me well known, who each acknowledged in my
presence that he had signed and executed the foregoing Bond for the
use and consideration therein expressed. |
And the said Cornelius Ennis and Robt
Brewster having been duly sworn by me, each and severally deposed and
said on oath that he is worth the full sum of fifteen thousand
Dollars, over and above all liabilities, constitutional allowance, and
exemptions from forced sale. |
