Sir,
   I am instructed by the Governor to acknowledge the receipt of your letter of the 28th ult., and to say that he concurs with you in your views as to the claim of Mr. Scott, of Macon {President, Macon & Western RR}, for pay for R. R. iron seized in Savannah by order of Gen. Jackson, with this qualification, that Mr. S. in equity is entitled to pay for his iron at the fair market value in Sav. at the time it was seized whether over or under $55 pr ton of 2240 lbs., with interest on the am't from the time of seizure till paid.
   By direction of his Excellency, I have just addressed a letter to Mr. Scott (a copy of which I enclose) stating the views of his Excellency in the premises, & that the gunboat association will pay him at the rate of $55 per ton of 2240 lbs, and that he will recognize the claim for whatever am't, if the market value was above that figure, may then remain due.
