Sir,
   Your letter of the 17th instant enclosing the report of the arbitrators selected to ascertain the compensation to be paid to the Richmond Fredericksburg & Potomac Rail Road Company by the Confederate Government for the use of the hotel and race course company at Ashland and for damages done to the property, has been received.
   The rent ascertained by the arbitrators three hundred dollars ($300) per month to be paid to the Ashland Hotel Company from the time the Hotel has been occupied as a Hospital is approved and will be paid by this Department.
   The rent also ascertained for the use of the Club House and race course is approved and will be paid upon the proper amounts being presented.
   The assessment of damages by the arbitrators for the injury done to the Hotel buildings and grounds though doubtless reasonable and just cannot be paid by the Quartermaster Department under existing laws it has no authority to ascertain or pay damages. All such claims belong to the class referred to in the Act of Congress No 264 for the proof and payment of which no mode is provided by existing laws. Under the terms of that act such claims are required to be filed in the Attorney General's office where proof will be taken and the claims presented to Congress for their action.
