Returning papers relative to claim for iron
rails laid on connection at Charleston & suggestion that in as much as
the line was constructed as a military necessity & is used only for
military purposes that the C. S. pay for same or arrange to use them by
paying rent. |

The testeming(?) of Maj Sims endorsed by
the QM Genl to the effect that the road is a military necessity ought it
seems to me to exonerate the Rail Road Co from any claims for payment of
the Rails. They were furnished by the Govt and when her necessities
cease can be taken up. This is the only question presented on these
papers. They indicate however that claim is to be made on the Govt by
the State of So Ca & property by this RR Co for return of money expended
by them in constructing the Bridge. When this claim is presented it will
be time enough to consider the propriety of its allowance & no decision
upon that point is enclosed in this matter. |
