Resply retd to Lt Col Cone. The allegation
that cars belonging to the Govt or to other roads were placed upon this
road is not a substantial defence against the charge for lost stores
unless it appears that such cars were placed upon the road against the
concurrence of the authorities and that such loss was in consequence of
the shipment upon these cars. It certainly could not be claimed by the
road that the employment of other cars absolved it from the usual use
and diligence required of the RR Cos. The decision of Col Cone is
therefore approved. |
