I have the honor to acknowledge receipt of your favor of
8th inst to the President of this Company covering an account of this
company against the Confederate States for interest on Bonds, which was
refused to the Secretary of the Treasury and returned with the
indorsation "The Secretary does not understand the claim on the within
Statement," and I am instructed to make the necessary explanation. By
the terms of the agreement between the Government, & the Railroad
Companies in convention at Montgomery in April 1861, the Government was
to pay the transportation bills of the companies in its Bonds or
Treasury notes, the Settlements to be made monthly. The Government paid
our bills to the amount of $151,450 in its Bonds. The bills thus paid
were due on the first of the months named in the account above
referred to (& which is herein enclosed) and were ??? at the dates in
the left column, by giving us Bonds bearing interest from these
dates instead of from the dates at which the bills were due, and our
claim is for the interest accruing on the Bonds between the dates at
which our bills were due and at which dates the Bonds should have been
given to us: and the dates at which the Settlements were made from which
dates the Bonds bore interest. The Warrants given by the Quarter Master
on the Treasury for the Bonds to pay these bills stated on their face
the time at which the bonds were due to us and ought to have been
sufficient proof that the money was earned by us and due by the
Government at the dates mentioned in them. I beg to submit as an
argument in support of the justness of the present claim that the delay
in making the settlements was not the result of our neglect as all bills
were promptly furnished to the Quartermaster with the vouchers to
sustain them, and therefore we should not be expected to suffer by the
delay. I would also state that we perform the work on Government account
at about half the rates charged to private parties and these delays in
the settlements with the consequent loss of the use of the money have
subjected us to serious embarrassments, compelling us to borrow money to
carry on our business, (which is principally for the Government,). |
