I have the honor to enclose herewith three
accounts against the Government in favor of the Charleston &
Savannah Rail Road Company, which the President of that Company asks
my intercession to have settled. |
That for $11,325.00 is for the use of a
special train ordered and used, for 173 days by the General Commanding
and for which the Quarter Master refuses to pay since the first month
of its use, ????? this service is certainly not unreasonable and I
therefore respectfully recommend that the Quarter Master be instructed
to pay it, upon proper vouchers as to the service rendered. |
That for $4,443.42 is for interest due
upon liquidated accounts, or rather fractions of interest coupon that
were due at the time settlements were made, the Coupon, a part of
which belonged to the bond, having been taken off. This, it appears to
me, is an equitable claim and I can see no reason why the usage in
commercial transactions should not hold good in settlement of
Government accounts. I therefore recommend that this amount be
allowed. |
The amount for $1,152.32 is for hire of
engines from the Central Rail Road of Georgia to transport troops from
Savannah to Charleston, a service which the President of the
Charleston & Savannah road alleges his company were capable of
performing without hiring providing reasonable notice had been given
that the service would have been required, this is my judgment is no
excuse for not being prepared at Savannah with engines to meet any
demand that might be made upon that end of his road. I therefore think
this amount ought not to be allowed. |
