The above mentioned cars are not in as good order as when they were impressed, but OM Avert President of the Road having abandoned all claim for him thereof, have agreed to accept them as they stand. The prices above given were fixed by the State Commissioners of Alabama upon appeal from the award of the local appraisers. In discussing the question before the State Commissioners, attention was called to the fact that "the local appraisement was not made by the State Commissioners till 26 April 1864, though delays interspersed by OM Avery, still the payment should be made in the old issue, or in the new subject to a reduction of one third." Col. A. L. Rives Acting Chief of Engineer Bureau at Richmond Va. will pay the above balance of two hundred and forty four thousand, nine hundred and forty six & 48/100 dollars to O. M. Avery President Ala & Fla RRd Co. of Fla. on order, Subject to such reduction in new currency as he may determine, in view of the above related facts.
