Know All Men By This
Presents; That on the 26th day of September, A. D. 1861, in the
District Court of Harrison County and State of Texas, Henry Wickland
recovered Judgment against the Southern Pacific Rail Road Company, for
the Sum of Thirty-Five Hundred Dollars Principal and all costs of suit
in cause No. 3803. And on the 11th day of July, A. D. 1861, Execution
issued upon said Judgment and was received in the office of the
Sheriff of said County. And on day last mentioned, Also, on the
23rd day of October, 1860, in said District Court, J. B. Williams
recovered a Judgment against said Company for the Sum of Two Thousand
Four Hundred and Eight Dollars and Fifty Cents. And all costs of suit
in cause No. 3973. And on the 22nd day of November, A. D., 1860,
Execution issued upon said Judgment. And was received in the office of
said Sheriff on the 24th day of November, A. D., 1860. Also, on
the 6th day of April, A. D., 1859, in said District Court, A. M.
Sanders & Others for the use of the Officers of Court recovered
Judgment against said Company for the Sum of Three Hundred & 9/100
Dollars and costs of suit in case no 3701. Upon which last mentioned
Judgment Execution issued from time to time & were received into
the Office of the Sheriff of said County the Second One of which was
issued on the 25th day of May 1860, and was received in said Office on
the 23rd day of May, A. D., 1860. And the said Sheriff did on the
11th day of July, A. D., 1861, did levy the First Execution above
mentioned. And on the Third day of January, A. D., 1861, did levy the
next Two Executions above mentioned and on the 9th day of August, A.
D., 1860, did levy the last Execution above mentioned, on all the
right, title and interest the said Company had in & to the Rail
Road and Road-Bed, situated in Harrison County and State of Texas, the
Eastern Terminus being at Swanson Landing and running in the direction
of Marshal in said County. And also the Franchises, rights, privileges
and appurtenances thereunto belonging & cars, locomotives &
rolling stock. And no sale having taken place under the Levy made by
virtue of the Executions aforesaid in favor of J. B. Williams, a
Second Execution was issued upon said and received in the Office of
the Sheriff on the 28th day of May, A. D., 1861. And no sale of the
property aforesaid having taken place by virtue of the levy made under
the Execution aforesaid in favor of Amelia Sanson, A Second Execution,
and a Venditioni Expanos, was issued upon said Judgment on the 29th
day of March 1861. And was on the same received into the Office of
said Sheriff in pursuance of which said Execution, the Venditioni
Expanos aforesaid, and a 3rd Execution, a Venditioni Expanos issued on
the last Judgment aforesaid on the 15th day of July, A. D., 1861. And
which was received in the Office of said Sheriff on the 15th day of
July, A. D., 1861. I, A. W. Crawford, Sheriff of said County of
Harrison, on the First Tuesday in September, A. D., 1861, it being the
Third day of said month, did expose and offer for sale said Rail Road
& Road Bed, franchises, rights, privileges and appurtenances
thereunto belonging & cars, locomotives and rolling stock to the
highest bidder for cash, before the Court House Door in said County.
And H. S. Fulkerson for himself & such persons as he may associate
with himself, being the highest and best bidder, Bidding for said Rail
Road, Road-Bed, franchises, rights, privileges and appurtenances,
thereunto belonging & cars, locomotives and rolling stock, the Sum
of Seven Thousand and Five Hundred Dollars, the same was duly knocked
off to him as the purchase thereof. Now Therefore: I, A. W.
Crawford, Sheriff of said County, by virtue of the Authority in me
vested, and in consideration of the Sum of Seven Thousand & Five
Hundred Dollars, the receipt whereof is hereby acknowledged, do by
these presents bargain, sell & convey unto the said H. S.
Fulkerson and such persons as he may associate with himself as
purchaser and their associates & successors, the said Rail Road,
Road-Bed, franchises, rights, privileges and appurtenances, thereunto
belonging & cars. locomotives & rolling stock, hereby
Warranting and defending the title to the said property no further
than I as Sheriff am bound to do by Law. In Testimony Whereof, I
hereto sign my hand and done officially this the 8th day of September,
A. D., 1861. |
