This Indenture made and entered
into on this twenty third day of April in the year of our Lord one
thousand Eight Hundred and sixty two between the Alabama &
Mississippi River Rail Road Company of the first part and the
Confederate States of America of the Second part Witnesseth: that
whereas under the authority of an act of the Congress of the
Confederate States, entitled "an act to provide for the
construction of the Rail Road from Selma in Alabama to Meridian in
Mississippi" approved the 15 day of February 1862, The President
of the said Confederate States has advanced to the said Alabama &
Mississippi Rivers Rail Road Company the sum of One Hundred and fifty
Thousand Dollars for the purpose of completing the Rail Road
connecting aforesaid, and to secure the return of the money so
advanced has taken the promissory note of the said Alabama &
Mississippi Rivers Rail Road Company for the sum of One hundred and
Fifty Thousand Dollars being now ??? with these presents, payable ten
years after date and made payable to the Confederate States of
America. |
Now in consideration of the
promises and for the further consideration of the sum of five Dollars
by the party of the second part to the party of the first part paid
and to secure the payment of the amount specified in said promissory
note the party of the first part here bargained, sold and conveyed and
by these presents do bargain, sell and convey unto the party of the
second part all the entire Rail Road and Road bed owned by the party
of the first part and extending from the City of Selma on the Alabama
River to a place Called Reagan in the County of Sumter at the point of
intersection of the Alabama & Mississippi Rivers Rail Road with
the North East & South West Rail Road in said County of Sumter in
the State of Alabama and running by way of Uniontown and Demopolis
together with the fixtures depots and depot property, Machine Shop,
Rolling Stock and materials appertaining to said Rail Road and
belonging to said Company. This Conveyance is upon the condition
however that if said Alabama & Mississippi Rivers Rail Road
Company shall pay and discharge said promissory note by or before its
maturity then this deed of Mortgage is to become void, but if said
Alabama & Mississippi Rivers Rail Road Company shall fail or
refuse to pay said promissory note by or before the maturity thereof
then this Conveyance is to remain in full force, and the party of the
second part to have the right to foreclose and enforce the same. |
In Witness Whereof the President of the said Alabama
& Mississippi Rivers Rail Road Company has hereto signed his Name
and Seal of said company to be annexed on the day and date above
written being thereto authorized by a resolution of the board of
directors of said company of this date. |

I Jno M. Strong, a Justice of
the Peace in and for said county, hereby certify that personally
appeared, G. G. Griffin, President of the Alabama & Mississippi
Rivers Rail Road Company of said state, who is personally known to me,
and acknowledging that being informed of the contents of the foregoing
Deed of Mortgage, as President of said Company, and acting under the
authority of and in pursuance of a resolution of the board of
Directors of said company he voluntarily carried the Corporate Seal of
said Company to be affixed to said deed and signed the same as
President in execution of said deed, by and on behalf of said Company
on the day and year in said Deed Specified. |
