It is hereby agreed between the parties to
this contract that the Mississippi Central Railroad Company permit the
operation of its road between the Tallatatchi river and Holly Springs
by Benj. L. Taylor and Jno. L. Kirby upon the following terms -- say:
Benj. L. Taylor is to furnish an engine and machinery sufficient to
build two small cars and to do the wood work necessary in the
construction of said cars. He is to run said cars between the points
designated above at his own expense and to keep the track in good
running condition. The Railroad Company agrees to put said engine in
good order, to furnish the wheels, trucks and lumber necessary to
build the required cars and when ready to transport the whole free of
charge to the Northern terminal of its road. |
B. L. Taylor is to do any repairs to
engine and cars at his own cost and keep the track in good order also
at his expense, and is to pay monthly to said Railroad Company one
third of the gross receipts on said line from passengers and freight.
He is to make trip report to the office of said RRCo of his
operations, specifying the number of passengers each way and the
description, weight, and ownership of the freight and monthly render a
detailed account. It is further agreed that should it hereafter be
deemed advisable for said RR Co. to rebuild the bridge across the
Tallatatchi river and run its own cars to Holly Springs then the Roads
act shall terminate such said ??? otherwise to remain in full force
and effect during the ensuing six months, unless interrupted by the
public enemy or abrogated by mutual consent of both parties to effect
the party desiring its cancellation shall give fifteen days notice to
the other party of such desire. |
