Articles of Agreement |
Made this 1st day of August, Eighteen
Hundred and Sixty-two, between Capt. Henry McCoy, Assistant Quarter
Master, in the service of the Confederate States of America of the one
part, and James C. Turner for and in behalf of the Western North
Carolina Rail Road, of the other part. |

This agreement Witnesseth,
That the said Capt. Henry McCoy for and in behalf of the Confederate
States of America, and the said James C. Turner for and in behalf of
the Western North Carolina Rail Road Company, have mutually agreed and
by these presents do mutually covenant and agree to and with each
other in the manner following, viz: |
First. The said James C.
Turner for and in behalf of said Western N. C. Rail Road Co., does
tender to and allow the Confederate States of America the use of a
certain tract of land, situated between the tracks of the Western
North Carolina Rail Road and the North Carolina Rail Road running
parallel thereto and adjoining Depot of said Western North Carolina
Rail Road, being two hundred and sixty (260) feet in length and
forty-one (41) feet width. |
Second. The said
Confederate States of America to have the entire use of and control of
said tract of land, free of charge as long as the exigencies of the
service demands. |
Third. The buildings
that may be erected on said tract of land, may be retained by the said
Western North Carolina Rail Road Company at the actual cost of
material used therein, whenever the Confederate States of America no
longer has use of buildings or land. |
