| I J. T. Lloyd a Clerk of Said County, by
A. M. Clark Deputy hereby Certify that there are but two mortgages on
record in the Book of my office executed by the Houston & Texas
Central Rail Road Company -- 1 original executed to the State of Texas
dated July 29th 1859, under the provision of an act providing for the
loan of the School funded to Railway Companies, and another the Wm. M.
Rice & Daniel H. Page Trustees which said mortgage to said Reid
& Page expressly provides that the lien created thereby shall be
subject to a prior lien of six thousand dollars per mile given to the
State of Texas through its Board of School Commissioners upon the
first seventy-five miles of said Company's railway and to the same or
any other amount not exceeding eight thousand dollars per mile that
the said Company may give to the State of Texas for money loaned upon
the first seven and a half miles of the Fourth Section of said road. |
